Justice Ladiran Akintola of Oyo State High Court has dismissed a case filled by Oyo state Deputy Governor, Rauf Olaniyan over procedure to remove him from office by the Oyo State House of Assembly.
The court held that the lawmakers and all the defendants have not erred on the procedures taken.
According to the Court, the originating summons filled by the claimant was purely legislative procedure and not judicial in line with the constitution of the Federal Republic of Nigeria.
Rauf Olaniyan dragged the state House of Assembly to the court on matters that bothers on his petition by the lawmakers.
Olaniyan had through his lawyer, Chief Afolabi Fashanu, SAN asked the Court to order that the Speaker of the Assembly, Adebo Ogundoyin and the Clerk, Mrs Oludara Yetunde Awe be put on notice of the suit.
Recalled that Oyo State House of Assembly leveled five allegations against the Oyo State Deputy Governor, Rauf Olaniyan.
Twenty four members of the house wrote and signed the petition which was read during plenary on Wednesday.
